1. Provider and contact
SeenByAI is operated by Rafał Kawecki, a natural person carrying on unregistered business activity (działalność nierejestrowana) under Polish law (the “Provider”, “we”, “us”). Contact for all matters, including complaints: [email protected]. These terms are published in English; English is the language of the contract.
2. What the service does
SeenByAI measures how brands appear in the answers of generative AI assistants — ChatGPT (OpenAI), Gemini (Google), Claude (Anthropic), Grok (xAI) and Perplexity. We put industry questions to those assistants, analyse the answers, and report the results: visibility score, share of voice, position, cited sources, sentiment, trend and recommended actions.
- Free check — a one-off snapshot on a limited sample of questions. It is a sample, not a market audit.
- Subscription — recurring monitoring with history, a question library, reports and data export.
- Results reflect what third-party AI systems answered at the moment of measurement. Those answers vary by nature: we do not guarantee that a result can be reproduced, and we are not responsible for the content those systems generate or for decisions you take on the basis of it.
- We are not affiliated with, endorsed by, or acting on behalf of the operators of those AI systems. Their names and logos are the trademarks of their respective owners and are used to identify the systems we measure.
3. Who the service is for (B2B)
The service is intended for businesses and for people using it in connection with a business or professional activity. By entering into the contract you confirm that you use it in that capacity. If you nevertheless use it as a consumer — or as a sole trader entitled to consumer-equivalent protection under Polish law — mandatory consumer law applies to you, including section 6 below; the remaining provisions apply only so far as they do not conflict with it.
4. Account and free check
- You create an account with an email address (passwordless sign-in by magic link). You are responsible for access to your mailbox.
- The free check is available once per email address and requires confirmation via a link we send you.
- You are responsible for the accuracy of what you enter, and for ensuring that the brands and keywords you monitor do not infringe third-party rights.
5. Subscriptions, payment and lifecycle
- The paid plans (Starter, Pro, Agency) differ in the number of brands, the number of custom prompts, the AI engines covered and how often analyses run. Current prices and limits are on the pricing page, which forms part of the contract in the version in force at the time of purchase.
- Lemon Squeezy, LLC is the merchant of record: it handles payment, invoicing and taxes under its own terms. You manage your subscription in the customer portal.
- Subscriptions renew automatically every month. You can cancel at any time — access and monitoring continue until the end of the period already paid for; after that the account becomes read-only (history and data export remain available).
- If a payment fails we retry it (dunning) and keep your access for the duration of the retry period; if that period ends without a successful payment, the subscription expires.
- Once access has ended, download your data export within 30 days. After 30 days the account's operational data (brands, runs, results, history) is deleted automatically.
- Refunds: within 14 days of a first purchase, on request to [email protected].
6. Consumers — right of withdrawal
If you are a consumer (or a sole trader entitled to consumer-equivalent protection), you may withdraw from the contract within 14 days of concluding it, without giving a reason, by sending a statement to [email protected]. Performance of the service before that period expires takes place at your express request; if you then withdraw, you pay for what was performed up to the moment of withdrawal. Where the digital service has been fully performed with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal, that right does not apply.
7. Acceptable use and intellectual property
- You must not: abuse the API, circumvent limits or protections, monitor unlawful content, or resell the service without our consent — the exception being white-label reports delivered to an agency's own end clients under the Agency plan.
- The methodology of the service — in particular how the questions put to the AI systems are generated and selected, the analytical instructions and the scoring algorithms — is the Provider's trade secret. You must not reconstruct, extract or use it outside the service.
- You may use the reports within your own organisation, and under the Agency plan pass them to your end clients. The data you enter remains yours.
- API tokens issued to your account are read-only and personal to it; you are responsible for keeping them secret and for the traffic they generate.
- We may suspend an account that breaches these terms or generates excessive load, after prior notice where that is possible.
8. Complaints
Send complaints to [email protected], describing the problem, the account concerned and the outcome you expect. We answer within 14 days of receipt. Making a complaint does not exclude your statutory rights.
9. Liability
Towards businesses: the service is provided with due care, on an “as is” basis; we exclude warranty for defects (rękojmia) and liability for lost profits, and our total liability is limited to the fees paid in the last 12 months. These limits do not apply to damage caused intentionally. Towards consumers these provisions apply only so far as the law permits — they do not restrict a consumer's statutory rights.
10. Personal data
How we process personal data is described in the Privacy Policy. The product has data export (JSON) and permanent account deletion built in (panel → Delete account).
11. Changes to these terms
- We announce every change by email at least 14 days before it takes effect, stating what changes.
- If you do not accept a change, you may terminate the contract before it takes effect, with effect at the end of the period already paid for.
- Changes do not apply retroactively and do not change the price during a period already paid for.
- This is version 1.0, the first published version. Superseded versions will be linked from this page.
12. Governing law and disputes
Polish law governs. Disputes with businesses are heard by the court with jurisdiction over the Provider's place of residence; disputes with consumers by the court determined under the general rules. A consumer may also use the EU ODR platform or the assistance of a local consumer ombudsman (rzecznik konsumentów).
